One of the primary goals of the 1970s-era conservative legal movement was to undo New Deal policies that favored labor at the expense of capital. One of the movement's most effective strategies turned out to be advancing bipartisan legislation on arbitration and convincing the courts that settling disputes that way was preferable to litigation. Today, most consumers and employees today are bound by arbitration agreements, in which they are required to submit all future grievances to a private, binding system of arbitration and forfeit access to the legal system. Arbitration as originally conceived well over a century ago, however, stands in stark contrast to the arbitration in practice today. What changed is that Congress, the Supreme Court, and the private sector began to promote its use in the late twentieth century as a means of protecting corporate and other powerful institutional defendants from the costs of litigation and government regulation itself. How did arbitration shift from providing a low cost, less adversarial, and more efficient way of handling disputes between entities of equal bargaining power to a private, non-reviewable, compulsory forum for resolving disputes between individuals and corporations, often on unilateral terms? The most common legal business organization before the Industrial Revolution was the basic partnership that was confined to designated activities like a single long-distance voyage, fragile in the sense that it was easily terminable and ended with withdrawal or death of a partner and closed in the sense that partnership interests could not be traded. A few societies developed more complex business organizations like the Old Assyrian naruqqum, that facilitated larger capital accumulation and risk sharing than the basic partnership. They were broader in scope, more robust, lasted longer and were open to a larger number of parties. Economic demand for capital and risk sharing was the primary driver of business organizations in pre-industrial societies. Modern tax, liability and regulatory issues were largely absent in the pre-industrial world and did not play a role in the development of business organizations. Political and social factors did play a role. Innovation in business organizations is more likely where there is an entrepreneurial spirit --- as in the merchant oligarchy of Assur. Social and political factors also can block or delay development of business organizations, as seen with the Roman political and popular mistrust of large groups that limited the use of the societas publicanorum and the Islamic reluctance to legally recognize non-human entities. Family, Partnerships and Companies: From Assur to Amsterdam surveys business organizations before the Industrial Revolution in nine pre-industrial societies in their economic, political and social contexts: hunter gatherers, Mesopotamia and Near East, Egypt, Athens, Rome, the Islamic world, India, China and Europe. Police are required to obey the law. While that seems obvious, courts have lost track of that requirement due to misinterpreting the two constitutional provisions governing police conduct: the Fourth and Fourteenth Amendments. The Fourth Amendment forbids "unreasonable searches and seizures" and is the source of most constitutional constraints on policing. Although that provision technically applies only to the federal government, the Fourteenth Amendment, ratified in the wake of the Civil War, has been deemed to apply the Fourth Amendment to the States. This book contends that the courts' misinterpretation of these provisions has led them to hold federal and state law enforcement mistakenly to the same constitutional standards. The Fourth Amendment was originally understood as a federalism, or "states' rights," provision that, in effect, required federal agents to adhere to state law when searching or seizing. Thus, applying the same constraint to the States is impossible. Instead, the Fourteenth Amendment was originally understood in part as requiring that state officials (1) adhere to state law, (2) not discriminate, and (3) not be granted excessive discretion by legislators. These principles should guide judicial review of modern policing. Instead, constitutional constraints on policing are too strict and too forgiving at the same time. In this book, Michael J.Z. What does it mean to fail to recognise people's humanity? This book analyses dehumanization in the global migration crisis to answer this complex question. Through an original reading of the Ninth Amendment, Lawrence Rosen illustrates how a constitutional consideration for group protections might be applied to decisions arising before the Supreme Court, including the decision to overturn Roe v. Wade. Similarly, in other chapters, Rosen shows how a revised theory of culture can change the concepts--including those of "community"--that courts currently apply, whether it is the application of indigenous concepts of value to revise the statutes governing intellectual property, the importance to native peoples that burial remains be returned to the group, the role a community can play in the responsibilities attendant on the prudent investor rule, the cultural organization of Western states' water resources, or the implementation of a new basis for group defamation suits. How domestic courts in newly democratized states become willing and able to enforce international human rights law When do domestic courts protect international human rights? By the end of the twentieth century, the world had witnessed an unprecedented flourishing of international human rights law and a growing number of democratic states whose domestic institutions promised to protect those rights. A single institution often became the center of these efforts: the court. Advocates in newly democratized states could look to high courts to demand that their governments comply with international law and bring policy into line with liberal rhetoric. This process, however, put these young courts in a difficult position. With no deep well of historical legitimacy to draw on in new political environments, courts had to weigh high-minded legal principles against the limited resources or political preferences of elected governments. In such situations, how did these courts respond, and what strategies allowed some to successfully build their legitimacy over time while others faltered, succumbing to political pressure or suffering political backlash? In Between Possibility and Peril, Chris Kendall explores this dynamic in three states--Colombia, Mexico, and South Africa--in the twenty years following each country's democratic transition. The case studies reveal a common pattern: what matters most is not international law itself, but a court's ability to control its procedural environment. Control over these "rules of the game" allows a court to selectively engage international human rights issues that can enhance its legitimacy and build public support while avoiding those issues likely to put it in direct conflict with hostile political actors.
